GERMAN FEES SCALE
General Fee Structure: All fees are generally to be paid upfront. With exception to the initial consultation all mentioned fees are average and will be typically expected. However, in cases where more or less services are requested or needed, the fees will accordingly be changed. Installments or a payment plan can be negotiated when expressly wished.  All fees are subject to VAT (when applicable).
Court Cases: Fees for representing client’s interests are never subject to negotiation, the lawyer must take the full statutory fees as so is determined by Lawyer’s Remuneration Act (Rechtsanwaltsvergütungsgesetz). The value of dispute of visa / residence issues is usually € 5,000, which is the basis for all legal fees.

This means that in immigration matters, court fees compute to € 393 and the Lawyer’s fees € 420 for the processing of the case and € 390 for the hearing. These fees are flat. In the case installments are wished, they can only be for the Lawyer’s fees; the court fees must be forwarded with the first installment.

When the customer is in a shortage of time, the Lawyer shall proceed with the complaint when the client shows via transfer order from his bank that sufficient funds have been forwarded. The Lawyer will forward the court fees at no charge and at full personal liability to the court.
Personal Service: Whenever the client wishes to directly communicate with the Lawyer, or utmost personal attention, such can be offered for on a time fee basis. Utmost personal service can be understood as responding within 24 hrs after receipt, advancing any and all fees. The time fee will be € 200 / hr and a deposit of € 1,000 will be also required. The deposit will be returned to a German bank account after arrival in Germany.
Initial Consultation: ILAS will forward to the Lawyer the client’s response from the Visa Application Questionnaire form (with CV) at least identifying the client by first and last name as well as citizenship. Upon receipt of the client’s wishes from the Questionnaire, the Lawyer will determine which kind of permission best suits the client’s interests and what the general requirements are.

The Lawyer’s goals are to show a path of how to legally enter Germany. Follow up questions are generally not included in this service but can be obtained for a surcharge of € 50.

An initial consultation will be preformed within two working days after ILAS has declared that the Lawyer’s fees have been forwarded. This service costs € 150 flat.
Guarantee of Success: Upon special wish of the client and under the conditions as laid down in this paragraph, the lawyer will guarantee the success of the client’s application. Eligible clients are only such who have received an initial consultation to apply for a residence permit or visa and the Lawyer sees grounds for success and when the client actively pursues his application. Active pursuant of the application requires the client to supply the documents as mentioned in the checklist as soon as reasonably possible. When the office does not the grant the visa or residence permit and the reasons of refusal are imputed to the Lawyer, he will return all of his received fees for this consultation after the deduction of 30% of paid fees in order to cover necessary costs.

Alternatively, the client can choose to have his case heard in court at the cost of the Lawyer. This service will cost extra € 500 to be paid upon success.
Visa Application: The services for applying for a visa will contain the following services:

- determining which kind of visa is best for the client’s interests,
- pointing out which supplementary documents are to be submitted with the application and
- streamlining them.

The lawyer will inform the client in general of the application proceedings (duration, fees, opening hours, etc.). Whenever possible the lawyer will either provide either the mandatory application form or a link for an online form. This service will generally cost € 300.
Residence Permit for Employment Purposes: The services for applying for a residence permit for employment purposes will contain the following services:

- supplying a checklist for any all documents to be submitted and at which office to be submitted,
- streamlining supplementary documents,
- negotiating legal follow-up questions from the authorities,
- supplementary letter to persuade the authorities.

The lawyer will inform the client in general of the application proceedings (duration, fees, opening hours, etc.). Whenever possible the lawyer will either provide either the mandatory application form or a link to an online form. This service will generally cost € 800.
Resident Permit for Highly Qualified Professionals: This is virtually like a “normal” resident for employment purposes but with the main difference that the requirements are higher and more strictly tested because the client will receive permanent residency (settlement permit) from the very beginning.

The extended service will be in the extended argumentation needed. This service will generally cost € 1,500.
Business Plan: When applying for self-employment (freelancing), opening a business (corporation, company), a business plan is mandatory. The business plan will be contracted to Wandel Consultants GmbH as this company has the professional economical experience in planning businesses.

Their services cost € 1,000 plus VAT (where applicable). After the client finds his business, Wandel Consultant’s services can be used to subsidize our legal fees for further consultation.

Residence Permit for Opening a Business (Without Corporation): The services for applying for a residence permit to open a business will contain the following services:

- supplying a checklist for any and all documents to be submitted and at which office to be submitted,
- streamlining supplementary documents, negotiating legal follow up questions from the authorities,
- supplementary letter to persuade the authorities.

The lawyer will inform the client in general of the application proceedings (duration, fees, opening hours, etc.). Whenever possible the lawyer will either provide either the mandatory application form or a link to an online form.  Lawyer’s services will also include “proofreading” the business plan from a legal perspective. During application proceedings, the business plan will be studied and evaluated by the competent Chamber for Industry and Commerce (IHK). In order to speed up the proceedings the Lawyer will send a copy in advance to the IHK and discuss with this agency any follow up questions they typically have.

These services will cost € 2,000.
Residence Permit for Opening a Business (with Corporation): When clients intend to form a corporation in Germany and simultaneously want/need a corporation, then such corporation must at least “exist”, i.e. be so far prepared that it only needs to be founded (i.e. visiting notary public to sign the documents). Fees for the consultation / set-up are a matter of negotiation in relation to founding capital, complexity of articles, accompanying / representing to / at notary for founding, translation of documents, etc.
Residence Permit for Self-Employment (Freelancer): The services for applying for a residence permit for opening a business will contain the following services:

- supplying a checklist for any/all documents to be submitted and at which office to be submitted,
- streamlining supplementary documents,
- negotiating legal follow up questions from the authorities,
- supplementary letter to persuade the authorities.

The lawyer will inform the client in general of the application proceedings (duration, fees, opening hours, etc.). Whenever possible the lawyer will either provide either the mandatory application form or a link to an online form. Client will provide a business plan in German that will be proofread. These services will cost € 1,000.
Artist’s Permit: When an artist wants to live in Germany as a freelancer or self-employed, the following
services will contain:

- supplying a checklist for any/all documents to be submitted and at which office to be
submitted.

The lawyer will inform the client in general of the application proceedings (duration, fees, opening
hours, etc.). Whenever possible the lawyer will either provide either the mandatory application form or a link to
an online form. This representation will cost € 500.
Trailing Spouse or Children: When the spouse does not want to work in Germany but just live with the earning spouse and/or family, his application will cost ¼ as much as for the other “main” spouse.

Every person generally means a new case – especially for the authorities. Minor children will not be billed when they can be served absolutely parallel to their parent(s). Absolutely parallel means that children will enter at the same time and need no extra treatment. When a child needs separate treatment, the fees will be negotiated.
Accompanying to Foreigners Office: in Berlin € 200, Potsdam € 250 flat. The necessary fees to
accompany the client to other cities other than Berlin or Potsdam will be individually determined and “all inclusive”.
Police Registration: in Berlin € 100, Potsdam € 150 flat. It is not mandatory that the client visits this
office in person as long as Lawyer receives a power of attorney, the original copy of the form signed by the
client, and has the client’s passport. This service includes filling out the form so that the client only needs to sign it. After going in to the office, the client will receive his documents per registered mail returned. For other cities than Berlin and Potsdam, this service will only be offered when already assigned to accompanying the client to the foreigners office.
